1. About Giraffe Neck
Giraffe Neck is a general wellness and movement-reminder application for macOS. It provides reminders and simple guided movements intended to help users take short breaks during periods of computer use.
Giraffe Neck is not a medical device or healthcare service and does not provide medical advice, diagnosis, treatment, rehabilitation, or emergency assistance.
2. Health and Safety
The movements and reminders provided by Giraffe Neck are general information only. You are responsible for deciding whether they are appropriate for your health, physical condition, environment, and circumstances.
Stop the movement immediately if you experience pain, dizziness, numbness, weakness, nausea, loss of balance, unusual discomfort, or any other concerning symptom.
If you have an existing neck or spinal condition, recent injury, history of surgery, neurological symptoms, pregnancy-related concerns, or any other medical condition, consult a qualified healthcare professional before using the guided movements.
Do not use Giraffe Neck while driving, operating machinery, or in any situation where a movement reminder could create a safety risk.
Giraffe Neck does not guarantee that use of the app will prevent, improve, treat, or cure any disease, injury, pain, posture issue, or other health condition.
3. License and Permitted Use
Subject to these Terms and the applicable Apple terms, you are granted a limited, personal, non-exclusive, non-transferable, and revocable right to use Giraffe Neck on compatible Apple devices that you own or control.
You may use the app only for lawful, personal, or internal business purposes.
The app is licensed, not sold. No ownership of the app, source code, character artwork, animations, designs, trademarks, or other intellectual property is transferred to you.
4. Prohibited Use
Except where applicable law expressly permits otherwise, you must not:
- copy, sell, sublicense, rent, lease, distribute, or commercially exploit the app;
- reverse engineer, decompile, disassemble, or attempt to derive the source code;
- remove or alter copyright, trademark, attribution, or ownership notices;
- use Giraffe Neck, its name, character, images, animations, or design in a way that falsely suggests affiliation, endorsement, or authorization;
- use the app for an unlawful, harmful, fraudulent, or abusive purpose;
- interfere with the normal operation, security, or integrity of the app.
5. Purchases and Refunds
Giraffe Neck may be offered as a paid application through the Mac App Store.
Purchases, billing, receipts, payment processing, regional pricing, taxes, and refund requests are handled by Apple under Apple’s applicable terms, policies, and local law.
The developer does not directly receive or store your payment card details.
Nothing in these Terms limits any mandatory refund, warranty, or consumer protection right available under applicable law.
6. Privacy and Local Data
Use of Giraffe Neck is also subject to the Giraffe Neck Privacy Policy.
Reminder preferences, application settings, and exercise and reminder activity records are stored locally on the user’s device as described in the Privacy Policy.
Exercise and reminder activity records are not uploaded to a developer-operated server.
Deleting the app may not automatically remove every associated local preference file. Users may remove associated application data through the relevant macOS storage locations when necessary.
7. Updates and Availability
Giraffe Neck may receive updates that add, change, improve, or remove features.
The developer does not guarantee that every feature will remain available permanently or that the app will be compatible with every current or future version of macOS, device, configuration, or third-party service.
The app may be temporarily unavailable because of maintenance, technical problems, security issues, legal requirements, App Store availability, or circumstances outside the developer’s reasonable control.
8. Intellectual Property
Giraffe Neck, including its software, product name, original character artwork, animations, interface, text, graphics, and other original content, is owned by or licensed to LEI WANG and is protected by applicable intellectual property laws.
Apple, macOS, Mac, and the Mac App Store are trademarks of Apple Inc. The use of these names does not imply that Apple sponsors or endorses Giraffe Neck.
Any third-party names or trademarks remain the property of their respective owners.
9. Disclaimer of Warranties
To the maximum extent permitted by applicable law, Giraffe Neck is provided on an “as is” and “as available” basis.
The developer does not warrant that the app will be uninterrupted, error-free, suitable for every user, compatible with every system, or capable of producing a particular health, comfort, productivity, or posture outcome.
Some jurisdictions do not allow certain warranty exclusions, so some of these exclusions may not apply to you.
10. Limitation of Liability
To the maximum extent permitted by applicable law, LEI WANG will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to the use of, inability to use, or reliance on Giraffe Neck.
This includes, where legally permitted, loss of data, loss of business opportunity, loss of profits, device interruption, or injury resulting from use that is inconsistent with the safety guidance in these Terms.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability arising from fraud, intentional misconduct, gross negligence where applicable, or mandatory consumer protection law.
11. Apple Terms
If you download Giraffe Neck through the Mac App Store, your use of the app is also governed by the applicable Apple Media Services Terms and Apple’s Standard End User License Agreement, unless a valid custom agreement is expressly provided.
Apple is not responsible for providing support or maintenance for Giraffe Neck except where required under Apple’s applicable terms or law.
If these Terms conflict with mandatory law or applicable Apple terms governing the Mac App Store transaction, those mandatory requirements will apply to the extent of the conflict.
12. Changes to These Terms
These Terms may be updated when the app’s functionality, business model, legal obligations, or distribution method changes.
Updated Terms will be published on this page with a revised effective date. Where required by applicable law, additional notice or consent will be provided.
Continued use of Giraffe Neck after an update takes effect constitutes acceptance only to the extent permitted by applicable law.
13. Applicable Law and Consumer Rights
These Terms are governed by the laws that apply to the relationship between the user and the developer, without excluding any mandatory protections available to the user under the laws of their country or region.
Nothing in these Terms restricts rights that cannot legally be waived, including applicable consumer protection rights.
